Ïã¸ÛÁùºÏ²Ê lockers terms and conditions

Ïã¸ÛÁùºÏ²Ê lockers are provided for all Ïã¸ÛÁùºÏ²Ê current students to store personal belongings securely - the following terms and conditions apply.

These terms and conditions ("Terms") govern the access to and use of Intelligent Lockers at University College London ("Ïã¸ÛÁùºÏ²Ê"). These Terms only apply to Intelligent Lockers, which enable the User to access and use the Locker using their Ïã¸ÛÁùºÏ²Ê ID card and they do not apply to standard lockers wherever located on Ïã¸ÛÁùºÏ²Ê premises.

In using a Locker, the User agrees to comply with and abide by these Terms.

1. Interpretation

1.1 When the following words with capital letters are used in these Terms, this is what they will mean:

"Locker'' means an intelligent locker that is accessible using a Ïã¸ÛÁùºÏ²Ê ID card made available by Ïã¸ÛÁùºÏ²Ê on Ïã¸ÛÁùºÏ²Ê premises or premises made available to Ïã¸ÛÁùºÏ²Ê and which are allocated to the User by Ïã¸ÛÁùºÏ²Ê.

"Student" means a matriculated student of Ïã¸ÛÁùºÏ²Ê

"User" means any Student who, subject to these Terms and Conditions, uses a Locker.

2. Eligibility

2.1 Only Students of Ïã¸ÛÁùºÏ²Ê are permitted to be Users and to access and use the Lockers.

3. Allocation

3.1 Lockers are allocated on a first come, first served basis. There is no guarantee that a Locker will be available to a User at any given time.

3.2 The Lockers shall at all times remain the property of Ïã¸ÛÁùºÏ²Ê and Users shall not acquire any property rights in the Locker.

3.3 There is no charge for access to and use of a Locker.

4. Use

4.1 The Locker will be available to you for the period specified when you initially access the Locker. At expiry of that period, the User must collect all items stored in the Locker.

4.2 The Locker must only be used by the User for the purposes of storing personal belongings and for no other purpose. The User shall not allow any other person to use or access the Locker.

4.3 The Locker shall not be used for storage of any materials deemed to be inappropriate by Ïã¸ÛÁùºÏ²Ê including without limitation illegal or offensive materials, perishable items, valuable items or articles belonging to anyone other than the User.

4.4 Access to the Locker will be dictated by the opening hours of the building in which the Locker is located. Outside of those hours, the Locker will not be available and Ïã¸ÛÁùºÏ²Ê will not be liable to the User for the User being unable to access the Locker.

4.5 The User must keep the Locker in good and clean condition and the User must not do or omit to do anything that may result in damage to the Locker. If the User identifies that the Locker is damaged, they must immediately notify a member of Ïã¸ÛÁùºÏ²Ê Library Services staff. Ïã¸ÛÁùºÏ²Ê reserves the right to charge the User for the cost to repair any damage to the Locker caused by the acts or omissions of the User.

4.6 Users shall comply with all relevant Ïã¸ÛÁùºÏ²Ê rules, regulations and codes of conduct in their use of the Lockers. If a User breaches these terms, it will be treated as a disciplinary matter in addition to any potential criminal or civil action.

4.7 Ïã¸ÛÁùºÏ²Ê shall be entitled to routinely access the Locker at all times and without notice to the User for the purposes of security, maintenance and repair, ensuring and auditing compliance with these Terms and all other purposes deemed necessary by Ïã¸ÛÁùºÏ²Ê.

5. Data protection

5.1 By using the Lockers the User consents to the use of their personal data by Ïã¸ÛÁùºÏ²Ê to facilitate access to the lockers and management of the system generally. We collect personal data from you in accordance with our student privacy notice and data protection policy.

6. Termination

6.1 A User's right to access and use a Locker shall automatically cease:

6.1.1 upon expiry of the specified period of use; or

6.1.2 if and when the User ceases to be a Student.

6.2 Ïã¸ÛÁùºÏ²Ê may immediately terminate a User's access to and use of a Locker if the User is in breach of these Terms.

6.3 Ïã¸ÛÁùºÏ²Ê will normally give a User notice of termination or expiry of their right to use a Locker on the display screen for the Locker or otherwise in writing (including email).

6.4 On expiry of the right to use the Locker:

6.4.1 the User will be permitted to access the Locker on one occasion in order to remove its contents but will thereafter be unable to lock or access the Locker;

6.4.2 the User shall immediately remove all contents from the Locker;

6.4.3 if a User does not empty the Locker prior to expiry of the specified period of use, Ïã¸ÛÁùºÏ²Ê will be permitted to automatically suspend the User from accessing lockers for a period of at least 1 week.

6.5 If Ïã¸ÛÁùºÏ²Ê does or is entitled to terminate the User's right to access and use a Locker under clause 6.2, in addition to the provisions of clause 6.4, Ïã¸ÛÁùºÏ²Ê may suspend the User's access to and use of any other lockers on Ïã¸ÛÁùºÏ²Ê premises for such period as Ïã¸ÛÁùºÏ²Ê considers appropriate.

6.6 If, on termination or expiry of use of a Locker, the User does not remove all items from the Locker, Ïã¸ÛÁùºÏ²Ê reserves the right to access the Locker and remove any items. If Ïã¸ÛÁùºÏ²Ê does so, any items removed from the Locker will be passed to "Lost and Found" and will be dealt with in accordance with the Lost and Found Property process.

7. Liability

7.1 If Ïã¸ÛÁùºÏ²Ê fails to comply with these Terms, Ïã¸ÛÁùºÏ²Ê will be only be responsible for loss or damage that the User suffers that is a foreseeable result of Ïã¸ÛÁùºÏ²Ê's breach of the Terms or its negligence but Ïã¸ÛÁùºÏ²Ê is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by Ïã¸ÛÁùºÏ²Ê and the User at the time we entered into this contract.

7.2 The Locker is made available solely for personal, private use. The User shall not use the Locker for any commercial or business purpose. Ïã¸ÛÁùºÏ²Ê has not liability to the User under any circumstances for any loss of profit, loss of business, business interruption, or loss of business opportunity.

7.3 Ïã¸ÛÁùºÏ²Ê does not exclude or limit in any way its liability for:

7.3.1 death or personal injury caused by Ïã¸ÛÁùºÏ²Ê's negligence or the negligence of Ïã¸ÛÁùºÏ²Ê's employees, agents or subcontractors;

7.3.2 fraud or fraudulent misrepresentation;

7.3.3 any other liability that cannot be limited or excluded at law.

7.4 Items stored in the Locker are entirely at the User's risk. Ïã¸ÛÁùºÏ²Ê shall not be responsible or liable for any loss of or damage to items stored in the Locker except where such loss or damage arises as a direct result of the negligent acts or omissions of Ïã¸ÛÁùºÏ²Ê.

7.5 Without prejudice to clauses 6.1 and 6.2 and subject to 6.3, Ïã¸ÛÁùºÏ²Ê's total liability to the User, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with this agreement shall be limited to £500.

8. Disciplinary matters

8.1 Notwithstanding any other provision in these Terms, where the User's conduct in relation to use of a Locker is considered by Ïã¸ÛÁùºÏ²Ê to be in breach of Ïã¸ÛÁùºÏ²Ê's rules, regulations and codes of conduct, Ïã¸ÛÁùºÏ²Ê may invoke the student disciplinary policy and process.

9. Events outside our control

9.1 Ïã¸ÛÁùºÏ²Ê will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these Terms that is caused by any act or event beyond Ïã¸ÛÁùºÏ²Ê's reasonable control (Event Outside Ïã¸ÛÁùºÏ²Ê's Control), including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

9.2 If an Event Outside Ïã¸ÛÁùºÏ²Ê's Control takes place that affects the performance of Ïã¸ÛÁùºÏ²Ê's obligations under these Terms:

  • 9.2.1 Ïã¸ÛÁùºÏ²Ê will contact you as soon as reasonably possible to notify you; and
  • 9.2.2 Ïã¸ÛÁùºÏ²Ê's obligations under these Terms will be suspended and the time for performance of its obligations (principally making access to and use of the Locker available to you) will be extended for the duration of the Event Outside Ïã¸ÛÁùºÏ²Ê's Control.

9.3 If the Event Outside Ïã¸ÛÁùºÏ²Ê's Control is ongoing for longer than 12 weeks, either the User or Ïã¸ÛÁùºÏ²Ê may terminate access to and use of the Locker by giving notice in writing to the other party.

Other important terms

9.4 No-one, other than the User and Ïã¸ÛÁùºÏ²Ê, shall have any rights to enforce these terms.

9.5 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

9.6 If Ïã¸ÛÁùºÏ²Ê fails to insist that the User performs any of their obligations under these Terms, or if Ïã¸ÛÁùºÏ²Ê does not enforce its rights against the User, or if Ïã¸ÛÁùºÏ²Ê delays in doing so, that will not mean that Ïã¸ÛÁùºÏ²Ê has waived its rights against the User and will not mean that the User does not have to comply with those obligations. If Ïã¸ÛÁùºÏ²Ê does waive a default, it will only do so in writing, and that will not mean that Ïã¸ÛÁùºÏ²Ê will automatically waive any later default by you.

9.7 If a User wishes to contact Ïã¸ÛÁùºÏ²Ê in writing, or if any clause in these Terms requires the User to give Ïã¸ÛÁùºÏ²Ê notice in writing, the User can send this to Ïã¸ÛÁùºÏ²Ê by e-mail at library@ucl.ac.uk, by hand, or by pre-paid post at Ïã¸ÛÁùºÏ²Ê Library Services, University College London, Gower Street WC1E 6BT. If Ïã¸ÛÁùºÏ²Ê has to contact a User or give a User notice in writing, it will do so by e-mail, by hand, or by pre-paid post to the User's student email address and/or such other updated personal address provided by the User to Ïã¸ÛÁùºÏ²Ê.

9.8 These Terms shall be governed by construed in accordance with the laws of England and Wales and the parties irrevocably submit to the jurisdiction of English Courts.
